These Terms of Use ("Terms") govern your access to and use of SeekScape (the "App"), a mobile marketplace for wallpapers and live wallpapers ("Content") where purchases are made on the Solana blockchain using the SKR token. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
SeekScape is operated by KLKR Studio. Throughout these Terms, "we," "us," and "our" refer to KLKR Studio.
1. Eligibility
You must be able to form a binding contract in your jurisdiction to use the App, and you are responsible for complying with any laws that apply to you where you live, including laws around cryptocurrency, digital assets, and their taxation. The App is not directed at children, and you must meet the minimum age required by your jurisdiction and by the terms of the Solana wallet app you connect.
2. Your Wallet
The App does not create, host, or custody a wallet for you. To buy or unlock Content you connect your own Solana wallet app via Mobile Wallet Adapter. We never see, request, or store your seed phrase or private keys — every transaction is reviewed and signed inside your own wallet app, not inside SeekScape. You are solely responsible for keeping your wallet, device, and recovery phrase secure; we cannot recover funds, reverse a signature, or restore access to a wallet on your behalf.
If the App offers an optional device fingerprint/biometric lock, it only gates opening the App on your own device. It is a local convenience feature, not a wallet security feature, is handled entirely by your device's operating system, and has no bearing on your wallet's own security.
3. Purchases & Payments
- Prices are shown in SKR and are set by the Content's creator (or, currently, by us as the uploading admin — see Section 4).
- Every purchase is an on-chain SPL token transfer from your wallet, confirmed directly on the Solana network. We do not hold your funds at any point before, during, or after a purchase.
- Blockchain transactions are irreversible. Because of this, all sales are final once confirmed on-chain — we do not offer refunds for completed purchases, including for network fees, failed installs, or a change of mind. If a transaction fails to confirm, no Content is unlocked and no charge should occur; contact us via our publisher page, KLKR Studio, if you believe you were charged without receiving access.
- You are responsible for any Solana network ("gas") fees and for the accuracy of the wallet address you transact from.
- SKR is a volatile digital asset. We do not control its price, do not guarantee it will retain any particular value, and are not liable for losses caused by price movements.
4. Content & License
Content on the App comes from two sources: items uploaded by us as administrators, and items uploaded by independent creators through their own creator profile. Any wallet can sign in as a creator and submit Content; submissions are reviewed by us before they appear in the marketplace. Creators are responsible for having the rights to everything they upload, and by submitting Content they confirm that they do.
Purchasing an item grants you a personal, non-exclusive, non-transferable license to download and use that Content (for example, as a device wallpaper, a live wallpaper, or inside a home screen widget) for your own personal, non-commercial use. Purchasing Content does not transfer copyright or any other intellectual property right to you, and you may not resell, sublicense, redistribute, or otherwise commercially exploit purchased Content, or the underlying media file, without our prior written consent or the applicable creator's.
If an item is later removed or delisted from the marketplace (for example, following a takedown or moderation decision), that does not affect Content you already purchased — it remains in your Library and usable under the license above, even though new purchases of it are no longer available.
5. Acceptable Use
You agree not to:
- upload, or attempt to upload, Content you do not have the rights to distribute;
- use the App to launder funds, evade sanctions, or otherwise use it in any way that violates applicable law; or
- attempt to interfere with, reverse-engineer, or circumvent the App's purchase-verification or content-access mechanisms, or use automated means to scrape, mass-download, or resell Content in bulk.
6. Moderation & Availability
We may review, hide, or remove Content, suspend a wallet's access to marketplace features, or modify or discontinue the App (or any part of it) at any time, with or without notice, at our discretion — for example in response to a copyright complaint, suspected fraud, or a violation of these Terms. We will make reasonable efforts to preserve access to Content you have already purchased, but the App and its availability are provided on an "as is" and "as available" basis.
7. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THE SOLANA NETWORK OR YOUR WALLET APP WILL FUNCTION WITHOUT INTERRUPTION.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, DIGITAL ASSETS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, A BLOCKCHAIN TRANSACTION, YOUR WALLET, OR THE SOLANA NETWORK — INCLUDING LOSSES CAUSED BY NETWORK CONGESTION, A DROPPED OR FAILED TRANSACTION, A COMPROMISED WALLET, OR A LOST RECOVERY PHRASE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE AMOUNT (IF ANY) YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
9. Governing Law
Governing law for these Terms has not yet been finalized and requires clarification before this document should be treated as final. In the meantime, if you are a consumer, nothing in these Terms removes any protection that the mandatory consumer-protection laws of your own country of residence give you.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continuing to use the App after a change takes effect means you accept the updated Terms.
